Terms of service

These Terms of Service (“Terms”) govern your use of americantattoosociety.com (the “Site”) and purchases made through our online store. By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

1. Who we are

American Tattoo Society (“ATS,” “we,” “us”) operates tattoo and piercing studios and an online store. Our main office is at 5439 Yadkin Road, Suite 118, Fayetteville, NC 28303.

2. Eligibility & accounts

You must be 18 or older to place orders through the Site. You're responsible for the accuracy of information you provide and for maintaining the confidentiality of any account credentials.

3. Products, pricing & orders

We work hard to display products, pricing, and availability accurately, but errors happen. We reserve the right to correct errors, update information, cancel orders affected by errors (with a full refund), and limit quantities. An order confirmation email is our acceptance of your order. All prices are in U.S. dollars; applicable taxes and shipping are calculated at checkout.

4. Shipping & risk of loss

Shipping timelines shown at checkout are estimates. Risk of loss passes to you on delivery to the carrier. Report lost or damaged shipments to orders@americantattoosociety.comand we'll help resolve them with the carrier.

5. Returns & refunds

Returns, refunds, and retainers are governed by our Refund & Return Policy, which is part of these Terms.

6. Services are booked with studios, not the Site

Tattoo and piercing services are performed at ATS studios under a separate signed consent and waiver, and are subject to age, identification, and health requirements under applicable state and local law. Nothing on the Site is a guarantee of a particular service, design, artist, or appointment time. Retainers are governed by the Refund & Return Policy.

7. Intellectual property

All content on the Site — including the American Tattoo Society name and logos, custom tattoo designs, artwork, photography, videos, and text — is owned by or licensed to ATS and protected by trademark and copyright law. You may not copy, reproduce, distribute, or create derivative works from our content, or use our name, logos, or photographs in any way that suggests affiliation with, sponsorship by, or succession to American Tattoo Society, without our prior written permission. Unauthorized use of ATS trademarks or our photo library will be pursued to the fullest extent of the law.

8. Site content is not professional advice

Articles and guides on the Site — including content about military tattoo regulations — are provided for general information. Regulations change and unit policy may be stricter; always verify current requirements with your chain of command or recruiter. Aftercare content is general guidance, not medical advice; consult a healthcare provider for medical concerns.

9. Acceptable use

You agree not to misuse the Site: no unlawful use, no scraping or harvesting of content or data, no attempting to breach security, no impersonating ATS or others, and no submitting false or misleading information through our forms.

10. User submissions

If you submit content to us (photos, reviews, design references, form submissions), you confirm you have the right to share it and grant ATS a non-exclusive, royalty-free license to use it to provide our services and operate our business. Don't submit content you don't have rights to.

11. Third-party services

Checkout, payments, scheduling, and communications may be processed by third-party providers (including Shopify). Their services are governed by their own terms. Links to third-party sites are provided for convenience; we're not responsible for their content.

12. Disclaimers

The Site and store are provided “as is” and “as available.” To the fullest extent permitted by law, ATS disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.

13. Limitation of liability

To the fullest extent permitted by law, ATS's total liability arising out of or relating to the Site or a purchase is limited to the amount you paid for the product or service at issue, and ATS is not liable for indirect, incidental, special, consequential, or punitive damages. Some jurisdictions don't allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnification

You agree to indemnify and hold ATS harmless from claims arising out of your violation of these Terms or misuse of the Site.

15. Governing law & disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Cumberland County, North Carolina, and you consent to their jurisdiction.

16. Changes

We may update these Terms from time to time. The “Last updated” date reflects the current version, and continued use of the Site after changes means you accept them.
